Coaching service terms
Before booking a coaching service through our website it is important that you understand and agree to the following terms and conditions (Terms) which form a contract for the supply of coaching services (Agreement). This Agreement governs the relationship between the User (You), Flexijobs (We, Us, Our) and the Flexijobs Coach.
Please read these Terms carefully and make sure that you understand them, before booking any coaching services through our website. Please note that during the booking process you will be asked to agree to these Terms.
IMPORTANT: Please read our Cancellation and Refund Policy (Clause 6) very carefully as your rights to cancel your booking and receive a refund is limited.
You should print a copy of these Terms for future reference.
We amend these Terms from time to time. Every time you wish to order a coaching service, please check these Terms to ensure you understand the terms which will apply at that time. These Terms were most recently updated on 15th March 2013.
These Terms, and any Contract between us, are in French and English language. At any given time, the English version of the Terms will supersede the French version.
1. Interaction between You, Flexijobs and the Coach
1.1 It is up to you to determine whether a particular coach is suitable to your needs and requirements. Flexijobs cannot be held responsible for the availability or suitability of a particular coach.
1.2 If you are unsure that a coach is suitable for you, you can contact Flexijobs to help match a particular coach with your needs and the Flexijobs team will support you through the process. The ultimate decision rests with you.
1.3 Some coaches may offer a free introductory session before you book a paid session, You should contact the desired coach via the contact email to arrange an Introductory session.
1.4 Once a coach is booked through the Flexijobs website, the User should contact the coach to discuss his/her requirements and set out in a coaching plan and schedule. If additional sessions are required, these can be booked through the Flexijobs website.
1.5 If a coach is unavailable or in their opinion unsuitable for your requirements, the coach will refer your booking back to Flexijobs to assist with finding a suitable replacement.
2. How the contract for coaching is formed
2.1 Each coach has a professional profile that explains their qualifications, area of expertise, level of experience, particular services they can provide , and their fees for each hour long session. Each coach describes their services in their commercial offer.
2.2 If you agree with the fee, you should select the available date for your coaching session, you should include a brief summary of what you require from the session, your skype ID, your time zone and click on the ‘Book Now’ button.
2.3 Our booking process allows you to check and amend any errors before submitting your booking. Please take the time to reread and check your booking at each page of the process.
2.4 After you place an order, you will receive an e-mail from us acknowledging that we have received your order. However, please note that this does not mean that your order has been accepted. Our acceptance of your order will take place as described in paragraph 2.5;
2.5 We will confirm our acceptance to you by sending you an e-mail with a booking notification. The Contract between us will only be formed when we send you the Booking Notification.
2.6 If we are unable to supply you with the desired coach, Clause 5 and 6 will apply.
3. Booking a Coach
3.1 By proceeding with a booking you confirm that you have access to a Skype-enabled computer or other device and PayPal.
3.2 You should use the online booking platform to select the desired time and date from the coaching slots available.
3.3 The coaches will use their reasonable endeavours to keep their availability calendar up to date. However, it is possible that the coach may not be available for the selected date due to a delay in updating availability through the system. Neither Flexijobs nor the coaches can be held accountable for their availability during the booking process.
3.4 If there is a delay in the booking or payment process it is possible that the available slot will be taken by another user. In such a case you will receive a failure message and will be required to select the next available slot.
3.5 If a coach is unable to honour an available time slot already booked and paid for by you, the coach will contact you with the next available slots. If none of the available slots are suitable, the user may request a new time, coach or refund subject to the refund and cancellation policies below.
3.6 All booking payments are made through PayPal, once you have selected the available time slot you should click on “Pay now”, your booking will be temporarily reserved while you are transferred to PayPal and complete the payment.
4. Online Coaching
4.1 Coaching sessions are for 1 hour only. If you require longer sessions it is important that you agree the duration with the coach and ensure that additional sessions are booked through Flexijobs. This may require an alternative date to be selected to accommodate longer sessions and additional fees are payable.
4.2 On the date of your coaching session, the coach will contact you via Skype to commence the session. If you do not answer the Skype call, for whatever reason, within 15 minutes the session will be terminated and the booking fee is non-refundable. It is at the coach’s discretion whether to accept a later starting date, or whether a new coaching session needs to be booked.
4.3 After your coaching session, please take 15 minutes to send us by email your feedback (firstname.lastname@example.org) to enable Flexijobs to monitor the quality of the service of the coach and develop new services for you.
5. Onsite Coaching
5.1 For users requiring a coaching programme to be delivered to groups on-site (mainly applicable for employers), it is possible to agree a separate booking and payment through the coach. Once the coach and the client have agreed a coaching programme and a set fee for the intervention, the information will be communicated to FlexiJobs so that an invoice can be issued to the employer promptly. The employer should ensure that they comply with terms of payment as the coach will only get paid once payment has been received. The client will then need to pay to FlexiJobs bank details as provided on the invoice.
5.2 Any agreement for on-site coaching is between you and the coach and Flexijobs cannot be held liable for any travel expenses, meeting room expenses or other expenses occasioned by the on-site or face to face meetings.
5.3 FlexiJobs cannot be held liable for the standard of service delivered by the coach by on-site meetings. It is the sole responsibility of the client and the coach to decide an appropriate standard of work and the expected performance and outcomes using the template provided by FlexiJobs.
6. Cancellation and Refund Policy
6.1 If a coach is unavailable on the desired time slot in accordance with paragraph 2.5 above, the coach will contact you by e-mail to seek one of the following alternatives :
6.1.1 Rebook the coaching session at the next available future date ;
6.1.2 Find an alternative coach on the Flexijobs website that matches your requirements ;
6.1.3 Refer you to the Flexijobs team for support in finding an alternative coach ;
6.2 If the options in paragraphs 6.1.1 to 6.1.3 are unsuitable or unsatisfactory to you, the coach will offer a refund of the booking fee.
6.3 Subject to your statutory right to cancel in Paragraph 6.5 below, If you cancel a booking within two weeks of the booked date, a no refund policy will apply. You may still re-schedule the booking with the coach. If you are unable to make the booked date, you may contact the coach directly to re-schedule the coaching session.
6.4 If you cancel a booking within 48 hours of the coaching session, a no refund and no re-schedule policy will apply.
6.5 Once we send you the booking notification, you may cancel the transaction at any time within 7 working days from the day after the day that you first receive the booking notification. Any refund within those time limits will be a refund of the purchase price of the coaching session (payable back via your original method of payment). If you are outside of that time, we are not obliged to give any refund for the booking.
6.6 Paragraph 6.5 does not apply if you have already attended the paid for coaching session with a coach, whether in full or part.
6.7 To cancel the agreement, you must contact us in writing by sending an e-mail to FlexiJobs (email@example.com). You may wish to keep a copy of your cancellation notification for your own records.
6.8 You will receive a full refund of the price you paid for the coaching session minus the Paypal applicable charges. We will process the refund due to you as soon as possible and, in any case, within 30 calendar days of the day on which you gave us notice of cancellation.
6.9 You will receive confirmation of your refund via Paypal only. If you require an invoice or credit note, it must be specifically requested from Flexijobs (firstname.lastname@example.org).
7. Events outside our Control
7.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this agreement that is caused by an event outside our control (definition : paragraph 7.2)
7.2 An event outside our control means any act or event beyond our reasonable control, including without limitation, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.
7.3 If an event outside our control takes place that affects the performance of our obligations under this Agreement :
7.3.1 We will contact you as soon as reasonably possible to notify you ; and
7.3.2 Our obligations under this agreement will be suspended and the time for performance of our obligations will be extended for the duration of the event outside our control.
8. Other important terms
8.1 We may transfer our rights and obligations under this Agreement to another organisation, but this will not affect your rights or our obligations under these Terms.
8.2 You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.
8.3 This Agreement is between you, us and the Coach. No other person shall have any rights to enforce any of its terms. The Contracts (Rights of Third Parties Act) 1999 or otherwise shall not apply.
8.4 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
8.5 If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing. Any waiver of default in writing will not mean that any past, simultaneous or future defaults have been, or shall be waived.
8.6 These Terms are governed by English law. This means a Contract for the purchase of services through our site and any dispute or claim arising out of or in connection with it will be governed by English law. All parties agree that the courts of England and Wales will have non-exclusive jurisdiction.
